NY court: Lousy workers deserve fair workplace too

NEW YORK (AP) -- A federal appeals court in New York says even mediocre employees deserve protection from sexual harassment.

The ruling Friday by the 2nd U.S. Circuit Court of Appeals restores a $5 million lawsuit by Renee Mihalik of Hoboken, N.J.

The court says there was substantial evidence that she performed her job poorly at Credit Agricole Cheuvreux North America Inc.

But it says a jury might find that her supervisor used her shortcomings as an excuse to humiliate and punish her for opposing his discriminatory behavior.

Mihalik alleges the company’s chief executive ran the financial services firm like a "boys’ club," subjecting her to suggestive comments and twice propositioning her for sex.

The company’s chief financial officer says he is disappointed by the ruling but confident the company will prevail at trial.
