Felony dismissed, other charges pending

BENNINGTON -- A man who was accused of encouraging a fight between a mother and her daughter had that charge dismissed by the state on Wednesday, the day he was scheduled to go on trial for it.
Rex Lane, 38, of Arlington, did however plead to a single count of violating release conditions in connection with that docket and was given a five- to six-month sentence.
Lane is being held without bail, however, because of pending second degree domestic assault, and interference with access to emergency services charges he was accused of in December.
According to Vermont State Police, in November Lane and Joy Bucchieri, 33, were charged in connection with the assault of a 15-year-old girl who lived with them in Arlington. According to police, the girl reported that Bucchieri had been at a school soccer game and been asked to leave for causing a disturbance. After she was presented with no-trespassing order, she became angry with the girl and blamed her. The girl told police that Lane suggested Bucchieri "teach her a lesson" and encouraged Bucchieri as she hit the girl a number of times.
Bucchieri pleaded guilty to domestic assault in February and was given a two-year deferred sentence.
According to another affidavit by State Police, in December a woman accused him of hitting her in the face with a pillow, however his fist was inside the pillow, and of grabbing her by the hair and shoving her around. The charge was a felony because of a previous domestic assault conviction. The state also charged Lane as a habitual offender, meaning that because he has at least three previous felonies, normal sentencing restrictions would not apply if he gains a new felony conviction.
