On Tuesday, August 5, 2014, my husband and I, along with other property owners of Nathaniel Court and Eden Way, attended the Development Review Board meeting.
According to Vermont Statute, Title 24, Chapter 117, Sub-Chapter 10, Section 4464 concerning hearing notice requirements for development review, we, the owners of the 42 Units at Nathaniel Court should have received written notice at least seven (7) days prior to the commencement of this Board’s July 15, 2014 public hearing on the Shires project.
No written notice of that hearing was ever received by owner(s) who actually live at the 432 South Street, Bennington, VT address.
Nathaniel Court Condominiums abut the site of the Shires proposed Monument View housing development off Silver Street.
At the meeting of August 5, 2014, I requested -- along with others who live at Eden Way who also were not notified -- that the "hearing be suspended until such time as the legal ramifications of this failure to follow state law is known and can be properly considered."
