WILMINGTON — A lawsuit alleges the Hermitage Club owes an architectural firm more than $360,000 for services associated with a hotel being planned at the company's private ski resort.
Bull Stockwell Allen Architects, mostly based in California, claimed it entered into a contract with the Hermitage Club in March 2015. A year later, a bill was sent out and the due date of April 10 was not met.
"The debt in the amount of $338,71 plus 1.5 percent contractual interest totalling $23,960 is currently unpaid," the lawsuit said. "The defendant (Hermitage Club) has received all the benefits of BSA's services without permission, and retention of that benefit without compensation would be unfair, unjust and would enrich the defendant at BSA's expense."
Two charges — breach of contract and violation of the Vermont Prompt Payment Act, and quantum meruit/unjust enrichment — were brought against the Hermitage Club.
According to the lawsuit, BSA filed a notice of a mechanics lien with the Dover Town Clerk's Office on June 25 and the Hermitage Club agreed to pay within 30 days.
The company failed to pay and did not meet terms within the contract.
Besides the amount of money owed to BSA, the group also is asking to be paid for costs associated with attorney fees, damages and interest.
The hotel project is on hold as the Hermitage Club waits on state approval.
An Act 250 permit for the company's master plan is needed before construction can begin.
