BENNINGTON -- A local man will serve at least six months in prison for assaulting a woman in the apartment they shared, and assaulting the woman's son in a grocery store parking lot.
David J. King, 39, of Applegate Drive pleaded guilty to misdemeanor domestic assault, second degree aggravated domestic assault, and violating release conditions. When released, he will be under a three- to five-year suspended sentence.
The state dismissed other charges of domestic assault, and violating releasing conditions along with a possession of a narcotic charge as part of the plea agreement.
According to an affidavit by Bennington Police Officer Lawrence Cole, on Dec. 14 at 11:22 a.m. police were summoned to Applegate Drive when a woman reported hearing noises from a nearby apartment that sounded like a woman crying, a banging noise, and a male speaking roughly. She told police the woman next door had asked her to call them if anything "bad" sounded like it was happening.
Police spoke to the woman in the apartment in question, and she told them King had grabbed her and thrown her into the bathtub during an argument. She said King was changing her child's diaper and pinching his ear in order to get him to use the toilet. She said she had pinched King's ear and told him to stop handling her son in such a fashion, that was when he grabbed and threw her.
King told police he was not doing anything out of the ordinary with the boy, and said he only pushed the woman away when she punched him.
According to a second affidavit, on Feb. 2 Bennington Police Sgt. Michael Plusch was summoned to the parking lot of the Aldi grocery store where a person reported seeing a man, identified as King, grab a small child by the shoulders and whip him into some shopping carts. Police went into the store and learned the child and the woman King was with were the same he was involved with on Dec. 14. King had been arraigned on domestic assault charged by then and was under court orders not to have contact with the woman. Police say King was evasive when answering questions.
