BENNINGTON -- A local man is facing two felony charges after a mother told police she saw him having inappropriate contact with her 7-year-old son.
Justin J. Cyr, 34, of Bennington, pleaded not guilty Tuesday to two counts of lewd and lascivious conduct with a child. Each charge carries a two-year minimum sentence if a conviction occurs. Judge Nancy Corsones imposed $25,000 bail on Cyr, citing his record of not complying with court orders and a felony escape from furlough charge. He is also not allowed contact with two children, or their mother.
According to an affidavit by Vermont State Detective Trooper Scott Dunlap, on Friday at 1:49 a.m. police received a call from a woman reporting that her son had been assaulted.
She told police that Cyr had come over to her apartment earlier and they played cards. Cyr told her he had consumed two 24-ounce cans of beer and asked if she had a condom. She told Cyr he should leave, then told him to lay down on the couch. Instead Cyr went to her bed and she told him he would have to move soon because she would be going to sleep.
The woman went to do laundry, then went to tell Cyr to move but did not find him in her bed. She checked her son’s room, and when she turned on the light, saw Cyr with the boy and touching him.
She told Cyr to leave, while he apologized, saying he had been asleep and dreaming of being with a woman.
Police spoke to the child, who said Cyr kissed his stomach and touched him. The child was reluctant to speak, according to police, who were under the impression he had been told not to speak of it. In a second interview with police, he claimed his mother had instructed him not to talk.
Cyr showed up at the Bennington Police Station on his own. He told police a story similar to the woman’s as far as having consumed alcohol, played cards, and gone to sleep. He said he was at first unaware that children were in the room he went to, but that he realized two were there once he was inside. He said he was lying in the bed of one of the children and was dreaming about a woman when the light came on and the child’s mother was yelling at him.
Cyr told police he believes the child is homosexual and said he removes his clothes often.
