BENNINGTON -- A Pownal man who police said exposed himself after a parent confronted him over assaulting their child was given a suspended sentence Wednesday after admitting to some of the charges against him.
James C. Martin, 22, of Nutmeg Avenue, pleaded guilty to misdemeanor simple assault, and prohibited acts. He was given a one- to two-year suspended sentence and placed on probation for two years, during which time he must undergo alcohol treatment.
According to Vermont State Police, on Aug. 3 they were sent to the Alta Gardens Mobile Home Park in Pownal, where they met a woman who said her son had been assaulted by Martin.
The juvenile victim told police Martin was intoxicated that day, and accused him of owing Martin money. He said Martin put him in a "choke hold" and punched him in the face twice.
The boy’s mother said she confronted Martin over the incident and Martin responded by exposing himself and making a lewd gesture while standing in public.
Police said they spoke to some neighbors who said they saw Martin expose himself and they claimed children had also seen this.
