Jared Starr, 26, of Stillwater, N.Y., pleaded not guilty to a third offense of driving while under the influence of alcohol. He was released under $5,000 bail with the conditions he not drive or consume alcohol. According to court records he was convicted of DUI in New York on Aug. 16, 2005, and Aug. 13, 2008 .

According to an affidavit by Vermont State Trooper Travis Hess, on Oct. 27 he was parked at Paulin's Store in North Bennington at 12:24 a.m. when he saw a 2004 Chevrolet Malibu drive by at a high rate of speed. Hess wrote the vehicle did not use its turn signal and so he turned on his blue lights and the vehicle pulled over, hitting the sidewalk. Hess wrote that Starr appeared intoxicated and said he had not had any alcohol, but the said he had four beers between 10 p.m. and 11 p.m. Hess wrote that Starr's blood-alcohol content was .160 percent.

Kimberly A. Young, 26, of Benmont Avenue, pleaded not guilty to a felony charge of embezzlement. She was released on conditions she not go to Walmart where she worked as a cashier.

According to an affidavit by Bennington Police Cpl. Christopher Lauzon, on Oct. 18 he spoke to Chris Colehamer, an asset protection manager at Walmart on Northside Drive, who said he has surveillance footage of Young stealing small amounts of cash or merchandise over a dozen times from Walmart. He said Young admitted to the thefts, which were investigated after Young's till started reporting shortages.

Lauzon wrote that Young did not give a statement to police. According to Colehamer, between Sept. 2 and Oct. 17, Young took $1,001 worth in cash and merchandise from the store. Most of the items were cigarettes.
