BENNINGTON -- A competency evaluation has been ordered for an elderly woman being charged with causing the death of an elderly man in January after she hit him with her car.
In April, Georgianna Carter, 87, of North Bennington, was arraigned on the felony and pleaded not guilty. If found not competent to stand trial, a felony charge of gross negligent vehicle operation resulting in a fatality against her would have to be dropped.
Carter’s attorney, Frederick Bragdon, told the court Monday he thinks that the case will resolve soon. He said he was requesting the evaluation after speaking with Carter’s family. Bennington Superior Court Judge Cortland Corsones said the court would notify Bragdon when an evaluation could be done so he can inform his client.
According to Bennington Police, on Jan. 26 Carter was driving on North Bennington Road when she hit Henry Chalifoux, 79, as he was crossing the road. He was taken to Southwestern Vermont Medical Center where he was pronounced dead.
